Milaki Subscription and Refund Terms
Effective date: [DATE]. Last updated: [DATE].
Pending counsel review. The paid tier was decided on 2026-11-06 (Milaki Plus, yearly with a 7-day free trial or monthly, App Store only, no lifetime). Do not publish or link this from the App or the App Store until counsel has reviewed it.
These terms apply to paid features of Milaki, sold by [VERIFY: ORTHOREP LLC, a Washington limited liability company] ("we", "us"). They are part of the Milaki Terms of Use and the Privacy Policy also applies. If these terms conflict with the Terms of Use about purchases, these terms control.
Plans and Prices
Milaki Plus is sold through Apple’s App Store, in the iPhone app only, with these options (prices shown in US dollars; your local App Store price may differ). One subscription covers every language Milaki offers, including ones added later.
- Milaki Plus, yearly: $49.99 per year. Eligible new customers get a 7-day free trial, after which the subscription renews at the yearly price unless cancelled at least 24 hours before the trial ends. [VERIFY: matches App Store Connect]
- Milaki Plus, monthly: $7.99 per month. No free trial. [VERIFY: matches App Store Connect]
There is no one-time (lifetime) purchase.
The current prices are shown in the App before you buy. The price you see in the App Store listing and before you buy is the price that applies to you, in your local currency, as set by Apple. Prices may include or exclude taxes as Apple shows them for your country. [COUNSEL: price display and tax-inclusive pricing rules in Australia (GST), New Zealand (GST), and Canada (GST/HST/QST).]
How Billing Works
Apple handles billing. By purchasing, you agree to the following Apple-standard terms:
- Payment is charged to your Apple ID at confirmation of purchase.
- Paid features are sold only through Apple In-App Purchase. We do not take your card or payment details.
- Purchases are made on iPhone. The web app has no purchase option. [CONFIRM]
- The currency is set by Apple based on your App Store country. We do not control exchange rates, taxes, or Apple’s payment methods.
- Apple handles billing, receipts, and payment problems. [VERIFY: Apple’s current wording for the Apple Account name.]
Automatic Renewal
Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the end of the current period.
The renewal price is the price shown when you subscribed, unless the price changes as described below.
Free Trials
- Eligible new customers get a 7-day free trial of Milaki Plus, yearly. Apple decides eligibility, and each Apple Account can usually use a trial once.
- If you do not cancel at least 24 hours before the trial ends, the subscription renews at $49.99 per year.
- Any unused portion of a free trial is forfeited if you switch to the monthly plan. [CONFIRM]
- We will show the trial length, the price after the trial, and the date billing starts before you start the trial.
How to Cancel
You can manage or cancel a subscription in the App ([VERIFY: Settings > Manage Subscription]) or in iOS Settings › your name › Subscriptions. Cancellation takes effect at the end of the current period, and you keep access until then.
- On your iPhone, open Settings, tap your name, then tap Subscriptions. [VERIFY: current Apple menu path, which Apple may rename, such as Settings > Apple Account > Subscriptions.]
- Choose Milaki and tap Cancel Subscription.
Apple’s instructions: https://support.apple.com/HT202039 [VERIFY: link].
Deleting the App does not cancel a subscription.
One-time plan versus subscription. Buying a one-time plan (for example Lifetime) does not cancel a running subscription. If you want to switch from a subscription (or its trial) to a one-time plan, cancel the subscription first so it does not renew. [CONFIRM]
Refunds
Refunds are handled by Apple under Apple’s policies. Request them through Apple, not through us, at https://reportaproblem.apple.com [VERIFY: link]. Because Apple collects the payment, we generally cannot issue App Store refunds ourselves, but this does not limit the rights described below. [COUNSEL]
Your statutory rights are not affected. Nothing here removes or limits any right you have under consumer law that cannot be excluded. This includes:
- Australia: the consumer guarantees in the Australian Consumer Law, which may entitle you to a repair, replacement, or refund for a major failure.
- New Zealand: the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
- Canada: the consumer protection laws of your province or territory, including any cancellation or cooling-off rights.
If you think you have such a right, you may contact us at [PLACEHOLDER: [email protected]] and we will work with you and Apple. [COUNSEL: Does Apple’s refund-only path meet our obligations in AU, NZ, and Canada when we are the supplier of the service? Should we offer our own remedy when Apple refuses? Is there any cooling-off rule for digital subscriptions in Quebec or Ontario?]
Price Changes
We may change prices for new purchases at any time. If the price of a subscription you already have goes up, Apple will notify you, and where the law or Apple requires your consent, the new price applies only if you accept it. If you do not accept, the subscription ends at the end of the current period. [COUNSEL: advance notice and consent rules for price increases in AU, NZ, and Canada, including Quebec.]
If Your Subscription Ends
If your trial or subscription ends, you can still open Milaki, view your progress and history, and export your data. Your saved words, progress and Review stay free. Milaki Plus stories close until you subscribe again, except that if you paid for Milaki Plus (not only a free trial), stories you finished stay readable. [CONFIRM: matches the access build] We will not delete your on-device data because a subscription ended. If you have an account, we keep it unless you ask us to delete it.
Restore Purchases
If you reinstall Milaki or use a new device, choose Restore Purchases (in the paywall and in Settings) to bring back what you bought. Restoring purchases uses the Apple ID that made the purchase. You do not need to sign in to a Milaki account to restore. [VERIFY: purchases will be tied to the Apple ID, not to a Milaki account.]
Family Sharing
[CONFIRM: pick one.] Option A: Milaki purchases are not shareable through Apple Family Sharing. Option B: Milaki subscriptions can be shared with your Apple Family Sharing group, as Apple’s rules allow.
Changes to Paid Features
We may change or stop offering paid features. If we stop a feature you paid for in advance, we will [PLACEHOLDER: remedy, such as a refund request path through Apple or a free replacement]. [COUNSEL: AU and NZ rules on removing paid features.]
If We Ever Sell on the Web
[COUNSEL: This section is a placeholder only. Today there is no web purchase. If we ever sell on the web, for example through Stripe, these terms need a full revision and legal review before launch. Questions:
- Refund policy and who issues refunds (we would, not Apple).
- State automatic-renewal laws, such as California’s Automatic Renewal Law (and the 2025 amendments), and similar laws in other states: clear disclosure, express consent to renewal, acknowledgment email, easy online cancellation, and renewal and price-change notices.
- The FTC’s "click-to-cancel" rule status and the Restore Online Shoppers' Confidence Act (ROSCA).
- Canadian, Australian, and New Zealand rules on online sales, renewals, and cancellation.
- Sales tax and GST/VAT collection.
- Apple’s rules on steering users to web purchases from the iPhone app, which differ by storefront and may change.
- Privacy Policy and Terms updates for a payment processor.]
